OVERVIEW
Welcome to Booty Factory.
These Terms of Service (“Terms”) apply to your use of our website, online store, products, services, events, classes, online courses, digital content, coaching and other services offered by Booty Factory (“Services”).
Throughout these Terms, “Booty Factory”, “we”, “us” and “our” refer to Booty Factory.
Our online store is powered by Shopify, which enables us to provide our products and Services to you.
By accessing our website, creating an account, making a purchase, booking a Service or participating in one of our Services, you agree to these Terms and our Privacy Policy.
If you do not agree to these Terms, please do not use our Services.
Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable law.
1. ELIGIBILITY, ACCOUNTS & INFORMATION
You are responsible for ensuring that any information you provide to Booty Factory when making a purchase, creating an account or booking a Service is accurate and current.
Where an account is required to access digital content or other Services, you are responsible for maintaining the confidentiality and security of your login information.
Your account and login credentials are for your personal use and must not be sold, transferred or shared with another person unless we expressly permit it.
We reserve the right to suspend or terminate access where we reasonably believe an account is being shared, misused or used in breach of these Terms.
2. PRODUCTS & SERVICES
Booty Factory may offer physical merchandise, event tickets, dance and twerk classes, private bookings, online courses, digital products, educational resources, coaching and other Services.
We make reasonable efforts to ensure descriptions, photographs, pricing and other information displayed on our website are accurate.
Colours, appearance and presentation of physical products may vary slightly depending on your device, screen settings and manufacturing variations.
We may update, modify or discontinue products or Services from time to time.
3. ORDERS, BOOKINGS & PAYMENTS
When you place an order or make a booking, you are offering to purchase the relevant product or Service.
Your purchase or booking is confirmed once payment has been successfully processed and your order or booking has been accepted.
You are responsible for checking the information associated with your purchase or booking and contacting us as soon as possible if you notice an error.
Prices may change from time to time. The price applicable to your purchase will generally be the price displayed at the time your order is placed, subject to correction of genuine pricing or listing errors where permitted by law.
All refunds, returns, cancellations and transfers are governed by our Refund Policy and any additional conditions clearly disclosed when you purchase a particular Service.
4. EVENTS, CLASSES & TWERKSHOPS
Bookings for Booty Factory events, classes and Twerkshops are subject to availability.
Your booking is confirmed once your purchase has been successfully processed through our booking system.
You are responsible for ensuring the information supplied when booking is accurate. Where reasonably required, you may be asked to provide your booking confirmation or the name associated with your booking when attending an event.
Event and class tickets are generally final sale and are not refundable because of a change of mind or because you are no longer able to attend, except where a refund or other remedy is required by law or provided under our Refund Policy.
If you can no longer attend, you may gift or privately resell your ticket to another person. You must contact Booty Factory at hello@bootyfactory.com.au with the relevant booking information and the new attendee's name so the booking can be updated.
Booty Factory may make reasonable changes to event schedules, instructors, venues, content or other event details where necessary.
Where Booty Factory cancels an event or makes a significant change, your rights and available remedies will be handled in accordance with our Refund Policy and applicable law.
5. PHYSICAL ACTIVITY, HEALTH & PARTICIPATION
Dance, twerking, fitness activities and other movement-based Services involve physical activity and may carry a risk of injury.
You are responsible for participating within your own abilities and for deciding whether a particular activity is appropriate for you.
If you have an injury, medical condition, are pregnant, have recently undergone surgery, or otherwise have concerns about participating safely, you should seek advice from an appropriately qualified healthcare professional before participating.
You should inform the instructor of relevant injuries, limitations or concerns before participating where appropriate.
You may choose not to perform any movement or exercise that causes pain, discomfort or that you do not feel comfortable performing.
Booty Factory does not guarantee that participation in dance, twerk, movement or fitness instruction will produce a particular physical, technical or performance result.
Nothing in these Terms excludes liability or rights that cannot lawfully be excluded.
6. ONLINE COURSES & DIGITAL CONTENT
When you purchase an online course, tutorial, downloadable resource or other digital content from Booty Factory, you receive a limited, personal, non-exclusive and non-transferable right to access and use that content for your own personal purposes, subject to any access period specified at the time of purchase.
Purchasing digital content does not transfer ownership of that content or its intellectual property to you.
Unless we expressly give written permission, you must not:
- share your course login or account with another person;
- reproduce, copy or redistribute course materials;
- screen-record, record or download content where downloading has not been authorised;
- upload Booty Factory content to another website, platform, social-media account or file-sharing service;
- sell, sublicense or commercially exploit our materials;
- provide purchased course content to another person who has not purchased access; or
- substantially reproduce our educational materials, tutorials or resources and present them as your own.
We may suspend or terminate access to digital content where we reasonably believe these Terms have been materially breached.
Your access period, where applicable, will be stated on the relevant product page or purchase information.
7. COACHING, MINDSET & LIFESTYLE CONTENT
Booty Factory may provide mindset, confidence, lifestyle, personal-development or coaching Services, courses, resources and educational content.
These Services are intended for general education, personal development and support.
Booty Factory and its representatives do not provide medical, psychological, psychiatric or other regulated healthcare advice, diagnosis or treatment unless expressly stated and provided by an appropriately qualified professional acting in that professional capacity.
Our Services are not a substitute for medical care, mental-health treatment or advice from an appropriately qualified healthcare professional.
You remain responsible for your own decisions, actions and wellbeing. If you have concerns regarding your physical or mental health, or require professional diagnosis or treatment, you should seek assistance from an appropriately qualified professional.
8. RESULTS & TESTIMONIALS
Every person is different.
Booty Factory does not guarantee any particular result from participating in our classes, courses, coaching, tutorials, programs or other Services.
Results relating to dance or twerk ability, confidence, mindset, lifestyle, personal development or other outcomes may vary depending on the individual, their circumstances, participation, consistency, effort and other factors outside our control.
Testimonials, reviews, transformations and customer experiences displayed by Booty Factory reflect individual experiences and are not a guarantee that another person will achieve the same or similar outcome.
9. PHOTOGRAPHY, VIDEO & CONTENT AT EVENTS
Booty Factory may photograph or film certain events, classes and workshops for promotional, educational and social-media content.
We understand that not everyone wishes to appear in this content.
If you do not wish to be photographed or filmed, please notify a Booty Factory team member before the class or event begins so we can take reasonable steps to respect your preference.
Where specific filming activities or group content require additional participation or consent, further information may be provided at the event.
10. COMMUNITY STANDARDS & BEHAVIOUR
Booty Factory aims to create a positive, inclusive, respectful and empowering environment.
Harassment, bullying, intimidation, discriminatory behaviour, deliberate exclusion, threatening conduct or other behaviour that compromises the safety or experience of attendees, staff or other members of the community will not be tolerated.
We reserve the right to ask a person to leave an event, class, online community or Service, or to restrict future participation, where we reasonably believe their behaviour poses a safety risk, seriously disrupts the experience of others or materially breaches these Terms.
11. PERSONAL BELONGINGS
You are responsible for your personal belongings when attending Booty Factory events, classes or Services.
To the extent permitted by law, Booty Factory is not responsible for personal belongings that are lost, stolen or damaged at an event or venue unless the loss or damage resulted from circumstances for which liability cannot lawfully be excluded.
12. PHYSICAL MERCHANDISE, SHIPPING & RETURNS
Booty Factory may sell physical merchandise through its online store.
Shipping times provided by us are estimates unless expressly stated otherwise. Delivery may occasionally be affected by circumstances outside our reasonable control.
Returns, exchanges and refunds for physical merchandise are governed by our Refund Policy.
Nothing in our Refund Policy or these Terms excludes or limits any rights or remedies you may have under the Australian Consumer Law.
13. INTELLECTUAL PROPERTY
Unless otherwise stated, the content made available through Booty Factory's website and Services—including branding, logos, photographs, graphics, written materials, videos, course content, tutorials, educational resources, downloads and other original materials—is owned by or licensed to Booty Factory and is protected by applicable intellectual property laws.
You may use purchased materials only for the personal purposes for which they were supplied unless Booty Factory provides written permission otherwise.
You must not reproduce, distribute, sell, publish, commercially exploit or represent Booty Factory intellectual property as your own without appropriate permission.
14. THIRD-PARTY SERVICES & LINKS
Our website and Services may rely on or link to third-party platforms and service providers, including payment providers, booking platforms, video hosting providers and other technology providers.
Your use of third-party platforms may also be subject to their own terms and privacy policies.
While we take reasonable care when selecting services used within our business, we do not control independent third-party platforms and are not responsible for matters outside our reasonable control, subject always to rights and remedies available under applicable law.
15. RELATIONSHIP WITH SHOPIFY
Booty Factory is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Booty Factory.
By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Booty Factory, including any injury, damage, or loss resulting from purchased products and services.
You hereby expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Booty Factory, to the extent permitted by applicable law.

17. WEBSITE USE & PROHIBITED CONDUCT
You may use our website and Services only for lawful purposes.

We may update these Terms from time to time to reflect changes to our Services, business practices, technology or legal obligations.

21. GOVERNING LAW
These Terms are governed by the laws applicable in Western Australia, Australia.
You and Booty Factory submit to the jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts, subject to any rights you may have under applicable consumer legislation.
22. SEVERABILITY
If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or severed to the extent necessary without affecting the validity of the remaining provisions.
